    Why Your Legislative Monitoring and Advocacy Efforts Should Be Year-Round

    State-based advocacy and legislative monitoring is highly seasonal. Each January, advocates and lobbyists head to capitol buildings. Most will spend the majority of their working time there, extending into the spring. This active legislative period is the busiest time of year for policy professionals. But this doesn’t mean that the rest of the year is spent merely waiting for January to come around again. Instead, government relations at the state level requires organizational attention and resources year-round. Year-round attention produces effective results during the busy legislative session.

    This doesn’t mean that policy professionals like yourself should stop taking those well-deserved post-session vacations. But developing an organizational understanding of what government relations work requires throughout the year helps your team plan their time and communicate their value to their organizations. 

    So what does a year in state-based public policy tracking and advocacy look like? Below, we’ve split the year up into thirds and detailed what a team should focus on within each period. Of course, you often find yourself balancing additional responsibilities that aren’t tied to the legislative calendar. It’s necessary to adjust your yearly planning to allow for other busy periods. Doing so helps ensure your team is never (too) overwhelmed. 

    It should be said that we know that states operate on different schedules. While the majority of states will spend the first third of the year in session, states like Massachusetts and California operate nearly year-round and are busiest in late summer. Adjust their calendars to align the “legislative session” third described below with your respective busiest months of the year at the capitol building. 

    The First Third: Active Legislative Session

    Once a state legislature is in session, it’s necessary to have your agendas, teams, software, and processes all in place. We’ll talk more about developing these later. You should be able to focus on operating within the legislature each day, and reacting to new developments. Within this time, three focuses are paramount: legislative monitoring or tracking, advocacy, and communications. 

    Legislative monitoring and tracking can be done in many ways. Some teams opt for a spreadsheet, while others prefer an advanced legislative intelligence system. We recommend the latter for efficiency and efficacy. Simply put, this involves identifying bills of interest and following their path through the legislative process. 

    Of course, advocacy takes many forms. In the state legislative space, advocacy involves impacting policy as it advances through the legislative process. This might include:

    • Efforts to stop harmful bills
    • Efforts to encourage the passage of priority legislation
    • Using your expertise to advocate for amendments to bills

    This work is, of course, informed by your legislative monitoring and tracking activities. When your tracker alerts you to an upcoming hearing on a bill, it can be an alarm for your team to organize an effort to gather speakers to testify. But the inverse is also true; advocacy informs your legislative tracking. Your organizing efforts should be logged into your tracker to best inform your legislative work going forward.

    Finally, communication is always key, but deserves special focus during the legislative session. External communication to your communities, activists, and supporters proves your value as a source of knowledge. It also helps to keep listeners engaged on the issues. On the other hand, internal communication to organizational leadership or financial bakers helps ensure these key stakeholders are aware of your successes and important legislative information. After all, many policy professionals serve as translators between their organizations and the legislature. This communication must go both ways.

    The Next Third: Digesting and Debriefing on the Legislative Session

    The second period of our calendar is informed by the first period. This period really begins when the legislature adjourns (and hopefully after a few weeks of rest post-session). This time should center around analysis and, again, communication. 

    Start by using your legislative tracker to glean two main analyses:

    1. An End-of-Session Recap. This recap details a narrative of the legislative session and the impact that your team had. Notably, this should include bills that became law, as well as those that did not succeed. It should be shared with both internal and external stakeholders. Your end-of-session recap is your team’s opportunity to tell your story of the legislative session, including your accomplishments.
    2. A Compliance Report. Focusing on just those bills that became law, this report informs compliance actions that must be taken as a result of new laws. This allows us to translate the impact of the bills we’ve been advocating on to our organization. It helps ensure we end up, and remain, in compliance ahead of the effective dates.

    Both of these projects accomplish the two main goals of this period:

    1. To digest and distill all of the legislative activity of the session
    2. To ensure all necessary information gets into the hands of those who need it

    A secondary goal during this period is relationship building, both with lawmakers and fellow advocates. As the capitol empties, their calendars (should) open up. The summer can be a great time to make the connections that there wasn’t time to make during session. Investing in this goal pays off in the form of more efficient and effective legislative sessions in the future.

    The Final Third: Elections and Session Planning

    Policy experts like yourself know that elections season includes many of the same faces as the legislative session, albeit in slightly different positions. Lawmakers become candidates, legislative aides become organizers, and constituents become voters. Regardless of your level of involvement in the electoral space, it’s important to keep track during this time period. Electoral outcomes determine the legislators you’ll be working with next year. C4s, or organizations that involve themselves in electoral work, tend to have more to do during this period. C3s and other more strategically conservative organizations take a back seat. Either way, following the outcome of state elections can inform. your communications and outreach strategy in the coming year.

    At the same time, this final portion of the year is the last opportunity to prepare for the upcoming chaos that is session. Now is the time to assess our processes and resources, to ensure we have everything we need for success. One key aspect of this work is establishing internal stakeholders and knowledge-holders. This may involve identifying a specific content expert, or creating a whole committee. Regardless, these individuals or groups should be available as a resource when needed during session. It’s important to ensure access to internal expertise. These resources allow you to make decisions quickly during the heat of the session. 

    This is also a time to research and develop your legislative agenda for the coming session. When I worked for a hospital system, we held meetings in each of our service areas about two months before session began. In these meetings, we heard the concerns and needs of each community. This feedback informed our legislative agenda, including specific bills we would aim to support as well as broader policy goals that might inform our action on many bills.

    Overall, it’s important to use these last few months before session to set yourself and your team up for success. Communicating and documenting everything you’ll need before lawmakers convene is key.

    ESG Trends To Watch in 2024

    The last few years have taught everyone from business owners to climate advocates to regulators to care about ESG. Increasingly, those following ESG policy in the U.S. have stopped watching what Europe is doing and begun assessing the impacts of policies and proposals at home. The landscape of ESG policy in the U.S. is complex and ever-evolving. It can be challenging to follow across fifty state legislatures, each different in their partisanship and ideology.

    Despite all the action on ESG, 2023 left many questions about the future of ESG policy in the United States. To get a better understanding of what might be up next for ESG policymaking, we reviewed what happened in 2023. In this blog, we identify trends that have begun to emerge so far in 2024.

    What is ESG?

    ESG criteria are a set of standards that have application in two primary contexts. Firstly, ESG investing involves the consideration of ethical and societal impacts while making investment decisiosn. This approach is aimed at encouraging more sustainable business models. ESG investing has gained significant traction over decades. In particular, but surged in popularity during the 2000s as a response to heightened consumer demand for corporate responsibility.

    ESG can also refer to government-imposed sustainability and responsibility reporting standards. In this context, regulatory bodies mandate that corporations adhere to reporting requirements on their environmental, social, and governance practices. In rarer cases, ESG reporting standards require corporations to meet predefined benchmarks. Regardless, assessment criteria may encompass factors such as carbon emissions, supply chain ethics, and risk management compliance.

    Europe has emerged as a frontrunner in ESG regulation. The European Corporate Sustainability Reporting Directive (CSRD) is considered by many to be a model for ESG regulation. Conversely, the U.S. has seen a burgeoning trend of anti-ESG regulation. In 2023, anti-ESG regulation was released in thirty-seven states. Absent federal intervention, the landscape of ESG law in the U.S. appears poised to become increasingly complex. This will certainly pose challenges and legal risks for companies seeking to navigate regulatory frameworks.

    What Happened With ESG Trends in 2023?

    Before 2023, regulatory oversight on ESG investing in the U.S. was minimal. Last year, we saw a notable increase in legislative activity on ESG investing. Evident at both the state and federal levels, this uptick was influenced by many factors. Recent initiatives from the Biden administration focus on ESG. On the other hand, the Republican party has positioned ESG as part of a broader agenda in the “culture wars.”

    In 2023, more than two-thirds of U.S. state legislatures deliberated anti-ESG legislation. As a result, fourteen states enacted laws restricting the incorporation of ESG factors in public investments and procurements. At the same time, pro-ESG legislation struggled to gain traction outside of California. In the fall of 2023, Governor Newsom signed two bills requiring large businesses to report their greenhouse gas emissions and climate-related financial risk. 

    There were also plenty of developments in ESG policy outside of the U.S. in 2023. The European Union made progress on finalizing and implementing the CSRD. The CSRD is an expanded and revised version of the existing EU sustainability reporting criteria – the Non-Financial Reporting Directive (NFRD). Beginning with the largest public companies, CSRD requirements will begin to take effect this year. 

    The EU also advanced the Corporate Sustainability Due Diligence Directive (CS3D) which will be enacted as early as 2024. The CS3D goes further than the NFRD and CSRD in holding companies accountable. It requires that companies take an active approach in preventing and mitigating human rights and environmental harms resulting from their business practices. CS3D requirements will not take effect until at least 2027. Yet, its development and passage represent a new step in ESG policymaking. 

    Finally, the African Union began studying ESG in 2023. Africa-based ESG policies will likely begin to develop across the latter part of this decade. 

    Key ESG Trends in 2024

    Many of the ESG policies developed in 2023 will go into effect, at least partially, in 2024. Further, many of the proposals that didn’t receive passage last year will be reintroduced and reconsidered. Below we broke down a few ways in which we expect ESG policy to show up in 2024. 

    “Anti-ESG” States Double Down on Successes in 2023

    Across the country in 2023, we saw two types of anti-ESG policies have significant success. The first includes proposals to limit the factors that public pension fund managers may consider in their investment decisions. New Hampshire’s HB 457, which became law in July, is an example of such an effort. The second area includes proposals to prohibit state government agencies from entering into contracts with organizations that use their own ESG criteria to determine the businesses they work with. Alabama enacted a law of this kind, SB 261, in June. 

    Both policy areas focus on public money and state decision-making relative to ESG. Some anti-ESG proposals have waded into the private sector, like Texas’s SB 833, which regulates insurance providers. However, the majority of successful bills were aimed at ESG’s role in the public sector. 

    We at Plural expect this trend to continue in 2024. States that have yet to pass anti-ESG legislation but which have the partisan makeup to do so may find success. Additionally, states that have already passed this type of legislation may double down in 2024. Already, Alabama’s HB 61 would, if enacted, expand last year’s ESG ban to more public contract processes. 

    ESG Moves From Policymaking to Practice

    As mentioned above, we have seen a flurry of development in ESG policy across the world. As we move forward, more and more of these policies will go from the realm of the political to the practical. This year represents the first in which some companies will need to follow the EU’s CSRD protocols. Additionally, the 2023 release of voluntary standards by the International Sustainability Standards Board (ISSB) may encourage more companies to begin to report on sustainability. 

    As these policies take effect, ESG consideration and reporting will continue to become a fact of life for large corporations. This new normal does not minimize the importance or the difficulty of complying with these complex regulations. 2024 will be our best look at how companies handle these new requirements.

    More policy in effect means, of course, more data for the public to ingest. After all, ESG reporting is meant to encourage companies towards better, more transparent business practices. Good reporting and public education will be necessary for this positive feedback cycle to work as intended.

    The SEC is the Primary ESG Policymaker in the U.S.

    Significant Congressional action on ESG is unlikely in 2024, especially as we near Election Day. Instead, those monitoring federal ESG policy will watch the SEC as it moves towards finalizing sustainability reporting rules. The SEC first proposed a rule requiring expansive climate reporting by publicly listed companies in 2022. The proposal has been met with significant pushback from the large corporations it seeks to regulate. If adopted, the proposal would represent a significant shift in ESG policy in the United States.

    The SEC has delayed the release of its final rule on this proposal several times. This is due, at least in part, to the opposition it has received. Yet, all signs point to a final decision being made by the SEC in 2024. Any new policy will take years to go into effect. They will likely be challenged in court before doing so. Still, the SEC’s forthcoming decision on ESG is perhaps the most significant moment in U.S. ESG policy seen thus far. 

    ESG and the 2024 Elections

    Policy topics as wonky as ESG rarely become a headline issue in U.S. elections. It’s unlikely that candidates’ positions on ESG will be the subject of commercials or debates. Yet, there are subtle ways in which the debate over ESG will play out in election discourse.

    Conservatives have sought to tie ESG regulations to a broader agenda they claim is hurting the economy for social gains. For example, former Presidential candidate and current Florida Governor Ron DeSantis included on his campaign website that he would not “tolerate woke corporations using ESG as an end-run around our constitutional system to impose heavy-handed, left-wing edicts through concentrated private power.” It’s likely that Republicans will continue to criticize ESG proposals alongside their recent opposition to DEI policies at colleges and universities.

    Across the aisle, Democrats seek to balance climate action with corporate partnerships on the issue. As such, Democrats will highlight President Biden’s modest action on ESG as evidence of a greater commitment to climate action. It’s unlikely that Democrats, at least on the federal level, will propose significant advances in ESG policy to appease corporate powers.

    With the ongoing implementation of the ACA, eligibility and enrollment to healthcare policies is an ongoing struggle. The ACA grants states the option whether to enroll in its provisions. As such, access to healthcare is unequally distributed across the United States.

    Texas currently has the largest population of uninsured residents in the United States. Nearly five million people do not have access to health insurance in the Lone Star state. There has been an ongoing conversation and effort to reduce this statistic.

    Texas lawmakers have demonstrated interest in reducing the number of uninsured Texans. In the past year, there has been a 37% increase in enrollment to the Affordable Care Act, also known as Obamacare. This is due in large part to the implementation of the federal Inflation Reduction Act (IRA). In 2024, advocates within Texas are hoping to continue this trend. They are pushing the state to expand access to Medicaid beyond children and adults with disabilities. Should the advocates succeed, an additional 800,000 Texans would receive access to healthcare. 

    Expanding Medicaid

    Medicaid expansion requires a coalition of legislators and advocates on both the federal and state levels. This is due to certain provisions of the Affordable Care Act (ACA). As of 2024, the most effective way to expand access to Medicaid is through state-level action. The Governor must sign on to expanding Medicaid to nonelderly people with incomes up to 138% of the federal poverty level. The states that have not yet done so include: Alabama, Florida, Georgia, Kansas, Mississippi, Tennessee, Texas, Wisconsin, and Wyoming. These states remain the emphasis of policy advocacy to ensure increased access. 

    Consumer Protection 

    Consumer protection from inflated healthcare prices and price-gouging practices has been a hot topic of conversation. Ongoing litigation and negotiations with pharmaceutical companies aim to prevent pricing people out of necessary healthcare. Many of these efforts are taking place at the federal level. At the state level, many governors are taking initiative in consumer protection efforts.

    Case Study: Consumer Protection Efforts in New York

    In New York, Governor Kathy Hochul hopes to enact the most expansive prohibition against insulin cost-sharing in the nation. The proposal would completely eliminate insulin cost-sharing through legislation. It would provide financial relief and improve adherence to these life-saving medications. With 1.58 million New Yorkers diagnosed with diabetes, this is poised to make a significant impact if passed. 

    Governor Hochul is also championing legislation that would prevent hospitals from suing patients earning less than 400% of the Federal Poverty Level, which is $120,000 for a family of four. It would also expand hospital financial assistance programs for low-income New Yorkers and limit monthly payments and interest charged for medical debt. 

    Reproductive Rights

    Since Roe v. Wade was overturned, reproductive rights have become a key issue across the United States. Thirteen states are set to address abortion in the 2024 elections. This includes:

    Voters in Colorado, Montana, and Nevada aim to uphold abortion rights through ballot initiatives. In Arizona, Arkansas, Florida, Missouri, Nebraska, and South Dakota, voters seek to expand abortion access. Iowa and Pennsylvania voters will consider constitutional amendments that would prevent abortion protection. Finally, both Maine and Maryland have referendums supporting abortion access. Maryland’s has already been approved for the 2024 state ballot.

    Federal Healthcare Policy Priorities

    The federal government is largely focused on making healthcare more affordable and accessible. Federal priorities include addressing social needs, expanding coverage, and ensuring access to care. Certain efforts to these ends are ongoing, due to the COVID-19 pandemic. These include reducing prescription drug costs, advancing health equity, and facilitating widespread vaccination. Measures are also in place to minimize out-of-pocket costs and provide enrollment assistance.

    Expanding Access to Care

    The FY24 budget includes Medicaid-like coverage for people in states that have not adopted Medicaid expansion under the ACA. It also includes financial incentives to ensure states with existing expansions maintain them. The budget also makes permanent the expanded ACA premium tax credits extended in the IRA.

    COVID-19 Recovery

    The COVID-19 pandemic is still ongoing and vaccinations continue to be necessary. Despite this, the federal government has deemphasized policy proposals for pandemic recovery.

    In addition to ongoing COVID-19 response and recovery, federal healthcare priorities include addressing social needs, expanding coverage, and ensuring access to care.

    Vaccination mandates and reporting provisions have drawn the ire of conservative lawmakers. Medicare currently requires that ambulatory surgical centers must report the COVID-19 vaccination status of their healthcare workers. On February 1st, a coalition of House Republicans introduced U.S. HR7216. The bill would effectively remove this reporting requirement. HR7049 also removes this requirement within the Veterans Health Administration. These policies are harmful to immunocompromised or elderly patients who are at greater risk of contracting COVID-19.

    Reproductive Rights

    The Biden Administration has placed a major emphasis on protecting reproductive rights. On January 24th, the administration released a series of statements related to this commitment. The Administration is committed to:

    • Protecting access to abortion and abortion medication
    • Ensuring access to Emergency Medical Care nationwide
    • Expanding support for reproductive healthcare workers
    • Defending reproductive rights in court

    The administration has also created a Reproductive Rights Taskforce. Their most recent report outlines a multipronged approach to protecting reproductive rights both legally in practice. The Taskforce outlined practices to ensure access to medication abortion, the most widely used form of abortion care. The Taskforce also set forth best practices to:

    • Enforce healthcare coverage for abortion procedures
    • Provide education for patients and healthcare professionals
    • Protect individuals’ ability to travel for abortion care when their states outlaw it
